PITTSFIELD SELECT BOARD SPECIAL MEETING MINUTES

PRESENT: Matt Corron, Dave Larkin, Patty Haskins, Bill Oren
AGENDA
1. Rescind approval for the new snowmobile route to come out on Lower Michigan Road, cross Route 100 and go down Parmenter Place.
2. Set date for re-warning proposed snowmobile route to come out on Lower Michigan Road, cross Route 100 and go down Parmenter Place.
3. William Oren v. Town of Pittsfield
Matt Corron motioned to open the meeting at 8:03 am. Seconded by Dave Larkin. Meeting called to order at 8:03 am.
Matt motioned to approve the agenda with no changes. Seconded by Dave. Agenda approved.
AGENDA
1. Rescind approval for the new snowmobile route to come out on Lower Michigan Road, cross Route 100 and go down Parmenter Place. Matt made a motion to rescind approval for the new snowmobile route to come out on Lower Michigan Road, cross Route 100 and go down Parmenter Place. Dave seconded. Matt and Dave discussed the current status of the trail that had been approved at the December 6, 2016 meeting. Matt called the vote. Motion carried. The trail is rescinded.
2. Set date for re-warning proposed snowmobile route to come out on Lower Michigan Road, cross Route 100 and go down Parmenter Place. Matt made a motion to set a date for re-warning proposed snowmobile route to come out on Lower Michigan Road, cross Route 100 and go down Parmenter Place. Seconded by Dave. Discussion ensued. Bill Oren has concerns: snowmobile club not getting signatures of all people affected along the proposed route; what the FEMA regulations allow on the town property that the route crosses; and the Board wasting town money when it is not benefitting the town’s people.
After discussion the Board decided they would like to have four things in place before the re-vote. 1. Seek FEMA approval if required for having snowmobile route cross Tweed River Open Space. 2. Seek Zoning approval if required for snowmobiles using a floodway. 3. Make sure proper signage is posted on town highway in conformance with the Manual of Uniform Traffic Control Devices as required by 23 V.S.A. § 1025. 4. Make sure snowmobile route meets any other statutory regulations for snowmobile travel on a town highway.
Matt motioned to re-warn the proposed snowmobile route for their regular Select Board Meeting on March 14, 2017 if the above requirements have been met, along with any other requirements that may become necessary for approval. Seconded by Dave. Motion passed.
3. William Oren v. Town of Pittsfield. Because discussing litigation strategy in public places the Town at a substantial disadvantage, Matt motioned to enter Executive Session to discuss this legal matter. Seconded by Dave. Board entered executive session at 8:25 am. Matt made motion to exit executive session. Seconded by Dave. Motion carried. Board exited at 8:53 am. Matt motioned to speak to attorney for further direction. Seconded by Dave. Motion carried. Matt will contact town attorney.
Matt moved to adjourn the meeting. Seconded by Dave. Motion carried. Meeting adjourned at 8:55 am.
